The Supreme court of India banned the "triple talaq"
The Supreme court of India has banned the controversial practice of Islamic divorce known as "triple talaq" in landmark decision, announced on Tuesday.
Practice that stretches for a thousand years, allows a husband to divorce his wife just by saying the Arabic word for divorce is talaq 3 times. A team of 5 judges unanimously banned the practice, which Srinivasan Balaji, one of the lawyers in the case, called "disappointing". Instead of 3 judges ruled that it is unconstitutional, while the minority was rendered a dissenting decision, which said that Parliament should pass a law officially banning the practice.
"The majority decision is that the "triple talaq" prohibited by law", - said Srinivasan. "From this moment on, in India the law is that there is no practice of "triple Talaka", which is considered valid."
India has the second largest Muslim population in the world, but, unlike other countries with large Muslim populations such as Pakistan, Bangladesh and Indonesia, is still officially passed laws prohibiting the "triple talaq".
