The actress allegedly hit a no-parking sign near her California home in the early hours of Saturday morning. It has been claimed she left the scene of the accident without telling the authorities.
Heather was cited for the misdemeanour after Ventura County Sheriffs looked at the scene of the accident and managed trace items left behind to her black 2005 BMW.
"While Locklear was technically arrested, she was not handcuffed or taken to a station because it was just a misdemeanour charge," sheriff`s spokesman Ross Bonfiglio told People magazine. "She was cooperative, but I can`t give any information about any statements she made. She was cited and released. She signed a document stating she would make a court appearance.
"It appears she drove up on a curb and hit the sign. We don`t have any hard evidence that alcohol was involved. We don`t know if anyone was in the car with her at the time."
A neighbour heard the incident at 4am, but did not call police until 7.48pm on Saturday evening. "Deputies went out to the area and found a knocked over `no parking` sign and obvious signs of a car that went up the curb, striking the sign," website TMZ, the first to report the incident, reports.
Heather`s lawyer Blair Berk has insisted it is unknown whether the 48-year-old was driving the vehicle at the time. "Ms. Locklear was cited with a misdemeanour traffic ticket as she is the registered owner of the vehicle. She was never taken into custody," the attorney said. "The matter is still being looked into as it is not yet clear who was driving the vehicle."
Heather is due in court on May 17.
The star was arrested for driving under the influence (DUI) in September 2008. The charge was eventually dropped, and Heather pleaded no contest to reckless driving. She was given three years- probation.
