Biography SAVIGNY Frizhrih Karl (Savigny Friedrich Karl)
(1779-1861)
Born in Frankfurt on Feb. 21, 1779, he began a teaching career in Marburg. In 1810-1842, Professor at Berlin University. He has held the post of Prussian Minister of legislation. Resigned in 1848. Died Savigny in Berlin October 25, 1861
. Works Savigny on Roman law include the history of Roman law in the Middle Ages (Geschichte des rmischen Rechts im Mittelalter, . 6 Bd., . 1815-1831), . Ownership (Das Recht des Besitzes, . 1803), . The system of modern Roman law (System des heutigen rmischen Rechts, . 8 Bd., . 1840-1849),
. Throughout the 19. Savigny ideas influenced the development of Western European and (to a lesser extent) the Anglo-American jurisprudence.

The main thesis of the historical school of Savigny outlined in the work of the summoning of our time in law and jurisprudence (Vom Beruf unserer Zeit fr Gesetzgebung und Rechtswissenschaft, 1814, Corr. ed. 1828), as well as in the introductory article in the 'Journal of Historical Jurisprudence' ( 'Zeitschrift fr geschichtliche Rechtswissenschaft', published in 1815-1850). From the perspective of the historical school, . right - not an arbitrary product of legislation, . as a consequence of the spiritual and historical experience of the people, . therefore can not be changed only through legislation, . but should be gradually reformed and 'organic',
. In this paper about the calling of our era Savigny opposed the proposal of the German lawyer Anton Thibaut (in a pamphlet need for a common civil law for Germany, . ber die Notwendigkeit eines allgemeinen brgerlichen Rechts fr Deutschland, . 1814) to the codification of civil law in Germany,
.

The philosophical position of the historical school, understood the right as an expression of 'national spirit' (Volksgeist), was a reaction to the legalistic approach to the law that prevailed in Germany in the early 19. Assuming the judge and the practice-lawyer above the law and the legislator, . and belonging to community mores, . customs and moral position of the important 'rational-speculative' written laws, . historical school made important adjustments in Western legal thought.,
